From time to time I get requests from copyright infringement defense lawyers who ask if I would add a link to their site.  If you are an attorney wishing to add your name/firm to the list, please contact me.  Note: I reserve the right to add or remove these listings as I see fit.

I’m not making any recommendation to use these lawyers, firms, or to hire an attorney at all.  That should be your decision, as it is highly personal and a serious matter.  Understand that lawyers are not generally cheap, but that it may also be in your best interest.  As many of the copyright defense attorneys now have more experience with these case, the fees for some have started to drop.  The Trolls and copyright owners have set their settlement fee schedule at a level they believe is under the cost you will pay a defense attorney – (screenshot).  One place to start for names of lawyers and firm for such matters is the EFF Subpoena Defense Resource page.

    today i got a call from Lutz saying they will move on me individually soon .

    kicker is , the erroneous case my alledged IP addy was targeted from ( mcgip, llc vs does 1-18 )

    Pacer case no. 238837 was dismissed WITH predjudice back in sept !!!!!

    to say ‘ wtf ‘, is putting it mildly .

    these prenda/steele/lutz people are galling to say the least……please send this to Ranallo or

    You should write to the Judge that was on that case. From what I understand, they can call you if your case was dismissed without prejudice; but if they are calling you on a dismissed with prejudice THAT should be sanctionable.

  5. By the way, I represented a named Jane Doe defendant in the Patrick Collins Inc. v. John Does 1-25 case no.: 11-cv-60571-KMM which was just dismissed as to all John Does as a result of Mr. Lipscomb’s “abusive litigation practices” the Order was entered 1/4/12 by Judge K Michael Moore. Mr. Lipscomb had violated Rule 11 by forging my client’s name to a JPTS. All remaining John Does should be made aware that there is no pending case, but Mr. Lipscomb’s office is still trying to collect settlements from the Does as usual.

I am a Doe in this case and so far haven’t had any luck obtaining the information through the clerk, attorneys, or boards.. It’s a shame that Miami-Dade keeps it’s docs so painfully hard to obtain. I live nowhere near Florida, Please help!

      They will not actually sue you in DC, as that would be the wrong jurisdiction. They will obtain your personal information from your ISP and then try to get you to settle – Pay out a couple thousand dollars usually. They could open a new case in NV by finding an attorney authorized to practice there. Very doubtful that will ever happen. For 99% of the Does who ignore and don’t’ pay up, the cases dies and the Troll moves onto new Does. Consider filing a motion to quash if possible. When the Troll calls, give him the Richard Pryor Response.

    This site has put my mind at ease…somewhat. As a John Doe in Denver who just rec’d the papers from Comcast via Liberty Media Holdings, I was awake all night worrying about this crazy untrue allegation. Had no idea what steps to take and am having a difficult time finding an attornet in Denver to file the motion to quash/vacate these requests from Comcast and the charges against me. I saw links to a few CO attorneys and will contact them as I only have until 8/16 to stop Comcast from releasing my personal info. Thanks to this site, I MAY be able to get some sleep

      Look up David Kerr.

      If you didn’t do it and the movie is not on your system, then get some sleep. They have nothing but the weak-ass evidence – the public IP address. Even with the negligence claim the LHM and Marc Randazza like to throw out, you are fine. The negligence claim has been (and will continue to be) kicked to the curb recently – don’t believe it. If you can take the heat, file a motion yourself or just ride out the threats from the Troll when he starts to call. Only get an attorney if you are served with a complaint/summons (not the one they sent your ISP). DO NOT call the Troll and talk to them. Keep reading all the posts and tell us what goes on.

        The papers I recd from Comcast say if I don’t respond with motion to quash or vacate the subpoena Comcast must release my name which seems to me to be the way for LMH to go after me as an individual rather than john doe 1-441. I am not sure I want to attempt filing a motion w/o a lawyer.

    I am a doe in one of the Malibu Media cases in MI Eastern District with a relatively new roll, Paul J. Nicoletti (who I guess also has cases in IN and IL apparently through my PACER searches). The does in my case have until the end of this month to file MTQ/sever/etc prior to the release of our information from our respective ISPs. According to PACER there have been no motions filed by any of the several dozen does involved. I’m hesitant to file one because as Ive seen on blogs such as this one, it tends to be the doe who files the motion who becomes one of the “example does” that actually gets named. Is there any role for filing a motion as an anonymous doe in the case? It appears that there are several presiding judges in my district on these cases and copyright trolling may be relatively new to this district as well…

    On the other hand, assuming no one (including myself) files a MTQ or similar, and we begin to get harassed by agents of the plaintiff for settlements my understanding is that the vast majority of those who don’t settle and use the richard pryor response don’t get individually named. In the slim chance that one eventually becomes one of the few that is individually named it would obviously be beneficial to retain counsel at that point and I assume settlement amounts become larger at that point… Am I correct in stating this? Anyone have any experience with Malibu Media or specifically Nicoletti in this regard? I dont have the time or money to defend myself if named as an individual doe unfortunately

      I’m in the same boat with you. I can’t find any information on Nicoletti, and reading all of these forums has filled me with conflicting answers. It sounds like filing a MTQ is both a good first move and a terrible idea. It also seems like the Richard Pryor Response is a good idea, but how is it given when you are never to talk to these people? Don’t pick up the phone or contact the lawyers, but be sure to give them the RPR..

        I too, just yesterday, received the notification from my ISP stating that I have until the end of October to file a MTQ or my name and address will be released. Again, it’s a Malibu Media / Nicoletti filing.

        To those before me in the same boat, what has happened? Did you file MTQ, how did it go? If you didn’t, what has happened since?

        I am trying to determine whether or not to submit the MTQ myself and am looking for any advice.

      I’m in southeast Michigan and I just got my John Doe subpoena notice from Comcast last week, courtesy of Nicoletti and Malibu Media. I’m wondering if it makes sense for folks to reach out to one of the IP lawyers in town to join forces a bit. I reached out to Hermann Law Offices this morning, no response yet. Given that the MTQ should read the same for all the Does I would hope for a group discount :-) Have any of the 253 Does in Michigan obtained local legal counsel?

        Yeah, I’m thinking about it and it’s a good idea to get one lawyer. I was looking at list and researched few lawyers and found that attorney Eric Grimm is currently involved with Nicoletti’s firm on cases related to Patrick Collins, Inc lawsuits. I’ll have to see how experienced he is and how far he went in stopping the lawsuits all together.

    I have a quick question for all the lawyers here. In Judge Howell’s decision in the DC AF Holdings case she explains that it is premature for the court to be concerned with personal jurisdiction and that a court may not dismiss a claim for lack of personal jurisdiction sua sponte.

    If that is accepted, my question is what would happen procedurally if a judge did not dismiss a case but also refused to grant expedited discovery without a showing of good faith for jurisdiction? I mean the case couldn’t go forward without the names of the defendants but can a judge do that or is there any reason they can’t? I’ve looked a bit but can’t seem to figure it out for certain.

      You are right that without the ISP subsriber information, the cases will not go forard. The judge will either let it go 120+ days and then close in IAW FRCP Rule 4(m) or tell them to show cause (do something) as why it shouldn’t be closed. Judges have rules to follow, but they are masters of their own domains and are very powerful. Piss one off and watch out!

    I hired one of the lawyers referenced here to file a MTQ. I saw that one other Doe on the case did the same with the same lawyer. I emailed the lawyer some questions, he blew me off, my life exploded and I haven’t followed up since but I’m definitely due to do so.

    Hey guys, I recently received a letter from Simmons Browder Gianaris Angelides & Barnerd LLC from the desk of Paul A. Lesko in regards to a music software called Nexus2 from the company reFX Audio Software Inc. It is a settlement offer for $5K. I have no money and no job so legal advice of the free variety is greatly appreciated. There are a couple problems I have with this. There is a discrepancy in the dates the of the claimed infringement. The original subpoena letter stated that the infringement occurred on {DATE} while the settlement letter claims a different one. Also, I also live in a different district from the one it was filed in. I can give more details if needed. Thanks!

      Doe – removed some info, as it could help to ID you. Email me the case number and any scanned document you have – doerayme2011@hotmail.com. I will see what I can find. The farther away you are from the filed jurisdiction the better. Many courts will allow a subpoena to be issued from one jurisdiction, but for a trial, they will have to come after you in the correct one. As it is in the same State, that means they would have to refile it.

    I commented earlier on default judgements, and had some questions I asked Rob Cashman but he has not replied yet. Am I correct in assuming most real plaintiffs (combat zone, k-beech, even Patrick Collins, Third Degree Films, Exquisite media, evasive angels etc) left the litigation scene? I have not seen any new filings for either of them, and I hear CP productions also quit trolling. Other than MM, which companies are you hearing more of and which have seemed to quit trolling? And since receiving my CEG Tek notices, I am watching suits in my jurisdiction (near NM but in neighboring state) and literally no trolling is active or pending in it, so will CEG sue in proper jurisdiction or are they still using the long arm statute. Sorry for the long questions but this is one months worth of questions after closely following your site.

    Any insight you can give is greatly appreciated.

      As far as I know CEG is still only sending out the link to their Web site via the DMCA notices to the ISPs. I haven’t heard of any new CEG cases on Does that failed to pay the $200 by the cut-off date. MM is the main Plaintiff now filing single Doe cases around the US. RFCExpress shows these less-known Plaintiffs for recent law suits – DMN Films, LLC, Elf-Man LLC, RynoRyder Productions, Inc., The Thompsons Film, LLC, The Bicycle Peddler, LLC, and reFX Audio Software, Inc. Prenda is on hold until they explode. ;)

    I have been named in a subpoena in Oregon. The Thompsons Film, LLC v. Does 1-155. Looking at the cases associated with the plaintiff’s council it seems their council (Crowell Law) is already making a few questionable choices (e.g. Voltage Pictures v. Does). QUESTION: I have noticed that the judge presiding over my case has/is presiding over several other cases that involve the same council as my case. Is that legal? It seems that would encourage a personal relationship between plaintiff’s council and the judge creating legal prejudice?

    Recently a subpoena was issued to a tenant in my house requesting information to pursue copyright infringement of Refx Nexus program. The subpoena passed and now a law-firm is requesting 4000 dollars for settlement. I am currently a college student and I very little money. The program in question was retail for 365 dollars. The prosecutors only have the information of the tenant who pays for the isp service, which is shared between 8 tenants, not of the actual person with the corresponding IP address related to the case. The amount for settlement is demanded by May 20th. What course of action should I take to get this settled. Should I ignore the settlement? Or should I try and get them to lower the requested offer? I’m very stressed at the moment and have no idea what to do next.

(This is not necessarily the state from which the subpoena was issued, but the state where the underlying lawsuit was filed.) Also, which state is the law firm that contacted you located in?
